OPERATING AFTER SUSPENSION OR REVOCATION OF LICENSE
G.L. c. 90 § 23
- A person is guilty of operating a vehicle after a suspended or revoked license if the Commonwealth can prove three elements, beyond a reasonable doubt:
- (1) That the defendant operated a motor vehicle;
- (2) That at the time the defendant was operating a motor vehicle his or her drivers license had been suspended or revoked; and
- (3) That the defendant, or an agent of the defendant, had received notice that his or her driver’s licenses had been or was about to be suspended or revoked.
