Members of the Cambridge Police Department conducted a motor vehicle stop of a rental car, which the defendant was operating in the Massachusetts Avenue area of Cambridge. During the course of the motor vehicle stop, officers discovered approximately two ounces of a substance that they believed to be marijuana. Upon conducting a check of the defendant’s Massachusetts Bureau of Probation record, officers learned that the defendant had previously been charged with possession with intent to distribute, of a class ‘d’ substance.
An application for issuance of a criminal complaint was filed by the Cambridge Police Department, which charged the defendant with Possession with Intent to Distribute, Class ‘D’ Substance, subsequent offense. On October 19, 2016 an evidentiary hearing was conducted before the Cambridge District Court.
Criminal Defense Attorney Vincent A. Tofani successfully argued that the application for issuance of the criminal complaint must be dismissed prior to arraignment, for lack of probable cause.
