Case Summary:

Members of the Watertown Police Department responded to the Target, following a report by the lost prevention staff of a young woman, suspected of concealing and removing various merchandise from the store with an estimated value of approximately $800.  Officers reviewed surveillance footage of the alleged behavior, and noted the make, model and license plate number of the motor vehicle in which the suspect was observed leaving the establishment.

The Watertown Police Department sought issuance of a criminal complaint, charging the suspect with felony larceny, and shoplifting by asportation.  An evidentiary hearing was conducted before the Assistant Clerk Magistrate at the Waltham District Court.

Criminal Defense Attorney Vincent A. Tofani appeared before the Assistant Clerk Magistrate of the Waltham District Court, and successfully argued that the application for criminal complaint must be denied for lack of probable cause, and the criminal charges were dismissed.
