The Somerville Police Department initiated an application for a criminal complaint, before the Somerville District Court, alleging that the defendant was involved in disturbing the peace and other reportedly unruly conduct at his shared residence. The Somerville Police Department further alleged that the defendant, as a tenant, failed to exercise reasonable care to prevent such unruly behavior at his apartment.
Criminal Defense Attorney Vincent A. Tofani challenged the complaint application initiated by aggressively cross-examining the investigating officers before the Somerville District Court Clerk Magistrate. Attorney Tofani successfully argued that the criminal complaint application should be denied for lack of probable cause. Following an evidentiary hearing, the Somerville District Court Clerk Magistrate denied the application for the criminal complaint.
