Case Summary:
Members of the Lynn Police Department Drug Task Force conducted surveillance of an area of the City of Lynn designated as a “high crime” area, with significant drug activity. Following cooperation from multiple confidential informants, members of the Drug Task Force conducted surveillance of a specific target address, suspected of drug dealing activity. During said surveillance, officers observed the suspect exit his motor vehicle and walk up the driveway while looking at his cell phone.
Officers observed the suspect involved in what they believed, based on their training and experience, to have been a street level drug transaction. Officers conducted a motor vehicle stop of the suspect’s vehicle, after observing an alleged civil motor vehicle infraction. The suspect was ordered to exit the motor vehicle, and a subsequent pat-frisk was conducted, which culminated in the discovery of a number of pills in a small cellophane bag, believed to be oxycodone. The suspect made various statements during police questioning, including the admission that he did not have a prescription for the controlled substance found on his person. The suspect was placed under arrest. During the booking process, investigators discovered additional contraband on the suspect’s person believed to be suboxone.
The suspect was arraigned before the Lynn District Court, and charged with the civil motor vehicle infraction, and illegal possession of a class ‘b’ controlled substance.
Criminal Defense Attorney Vincent A. Tofani appeared Lynn District Court, and successfully argued that defendant was eligible for a diversionary disposition, in lieu of criminal prosecution. Attorney Tofani negotiated a disposition with members of the Essex County District Attorney’s Office, where the defendant was given the opportunity to complete a drug treatment program, and the criminal charges were ultimately dismissed.
