October 20, 2015 – Brookline District Court – Clerk’s Hearing – Negligent Operation of a Motor Vehicle
Charges/Criminal Complaint Counts:
- Negligent Operation of Motor Vehicle;
- Marked Lanes Violation
Case Name: Withheld
Case Summary:
The defendant’s motor vehicle was stopped by investigating officers after receiving multiple calls from concerned citizens, describing the defendant’s erratic driving. The officers conducted a motor vehicle stop after observing the defendant’s vehicle crossing the centerline on multiple occasions. Additionally, smoke was emanating from the vehicle, and one of the tires appeared to be blown.
The operator was visually upset, and in a disturbed mental state. The police report alleged that the vehicle was slow to pull over, after the police cruiser emergency lights were activated. Officers issued a citation for Negligent Operation of a Motor Vehicle, and for Marked Lanes Violation.
Criminal Defense Attorney Vincent A. Tofani filed his notice of appearance, and requested a show case hearing before the clerk magistrate for the Brookline District Court. Attorney Tofani successfully argued that the application for criminal complaint should be denied on the grounds that the application failed to establish probable cause.
Criminal Case Results: Application for Criminal Complaint Denied and Case Dismissed.
