Case Name: Withheld
Members of the Lexington Police Department responded to a 911 call reporting a serious motor vehicle accident. Upon arriving at the scene, officers observed an individual on the roof a motor vehicle complaining of broken legs. The individual reported that he sustained the injuries, while travelling in the marked roadway on his motorcycle, when he was struck by an oncoming motor vehicle that crossed the center-line while making a left hand turn.
Following an investigation, members of the Lexington Police Department filed an application for issuance of a criminal complaint before the Concord District Court, which charged the defendant with Negligent Operation of a Motor Vehicle causing serious injury, and two civil motor vehicle infractions.
On August 19, 2016 an evidentiary hearing was conducted before the Clerk Magistrate of the Concord District Court.
Criminal Defense Attorney Vincent A. Tofani successfully argued that the allegations were unsupported by the record, and the application for criminal complaint must be denied for lack of probable cause.
