AFFRAY
G.L. c. 277, § 39
- A person is guilty of violating the law by engaging in an affray with others if the Commonwealth can prove three elements, beyond a reasonable doubt:
- (1) That the defendant fought with one or more other persons;
- (2) That the fighting took place in a public place; and
- (3) That at least one person who was lawfully present in the public place was put in fear as a result of the fighting that occurred
